DA victorious in historic Bitou Municipality court ruling

The Democratic Alliance (DA) is pleased to announce a significant victory in the recent court case against Bitou Municipality. This ruling not only validates the DA’s pledge to transparency and accountability but also sets a significant precedent for municipal governance across the country.

Key elements of the ruling include:

  1. The court has set aside the Municipal Council’s (First Respondent) decision to authorise the Mayor (Second Respondent) to enter into a mutual agreement with Mr. Memani (Fourth Respondent), effectively nullifying the agreement made on 3 May 2024.
  2. Mr. Memani’s termination as Municipal Manager has been revoked, reinforcing the necessity of adhering to due process in disciplinary matters.
  3. Mr. Memani is required to repay the full amount received under the mutual termination agreement, as is Bulelani Bans Inc. (Fifth Respondent), ensuring financial accountability to the municipality.

Additionally, the court has directed that the costs of this application, including those of two counsels, be covered by the respondents opposing the application.

This ruling underscores the importance of adhering to proper legislative procedures when dealing with senior officials in municipal governance. The DA remains steadfast in its mission to uphold integrity and accountability within all levels of government.
